RBBB CIRCUS WON THE CASE AGAINST ANIMAL DEFENDERS IN U.S.A !!!!
Feld Entertainment, Inc., the producer of Ringling Bros. and Barnum & Bailey® Circus,
announced today that the company has reached a legal settlement with
the American Society for the Prevention of Cruelty to Animals (ASPCA) in
connection with two federal court cases. Under the settlement, ASPCA
has paid Feld Entertainment $9.3 million to settle all claims related to
its part in more than a decade of manufactured litigation that
attempted to outlaw elephants in the company's Ringling Bros. ® Circus.
This settlement applies only to the ASPCA. Feld Entertainment's legal
proceedings, including its claims for litigation abuse and
racketeering, will continue against the remaining defendants, Humane
Society of the United States, the Fund for Animals, Animal Welfare
Institute, Animal Protection Institute United with Born Free USA, Tom
Rider and the attorneys involved.
"These defendants attempted to
destroy our family-owned business with a hired plaintiff who made
statements that the court did not believe. Animal activists have been
attacking our family, our company, and our employees for decades because
they oppose animals in circuses. This settlement is a vindication not
just for the company but also for the dedicated men and women who spend
their lives working and caring for all the animals with Ringling Bros.
in the face of such targeted, malicious rhetoric," said Kenneth Feld,
Chairman and Chief Executive Officer of Feld Entertainment.
The
parties filed dismissal papers today in U.S. District Court for the
District of Columbia as a result of their settlement. The settlement
covers only Feld Entertainment's claims against ASPCA for attorneys'
fees and damages in the initial Endangered Species Act (ESA) case filed
in 2000 by the animal rights activists and the resultant racketeering
(RICO) case brought by Feld Entertainment in 2007. Discovery in the
initial lawsuit uncovered over $190,000 that these animal activist
groups and their lawyers paid to Tom Rider who lived off of the money
while serving as the "injured plaintiff" in the lawsuit against the
circus.
"Our firm has been defending Feld Entertainment against
this onslaught of misguided litigation brought by animal activist
groups for years. As their attorneys, it is gratifying to finally have a
settlement that begins to make up for the harm inflicted on this
company, the family who owns it, and its employees," said John Simpson
of Fulbright & Jaworski L.L.P., lead counsel for Feld Entertainment
in all of the cases covered by the settlement with ASPCA.
Background of Case
The
original complaint was filed in July 2000 by the American Society for
the Prevention of Cruelty to Animals (ASPCA), the Animal Welfare
Institute, the Fund for Animals and Tom Rider, who is a former Ringling Bros. employee.
The case was dismissed in 2001 but was reinstated in 2003 after an
appellate court ruled that if Tom Rider could prove that he was injured
by Ringling Bros.' treatment of the elephants, the case could proceed. The Animal Protection Institute joined the case in 2006.
The trial began on February 4, 2009 and lasted approximately six weeks. The case is ASPCA, et al., v. Feld Entertainment, Inc., No. 03-2006 (D.D.C.)(Hon. Emmet G. Sullivan presiding).
On December 30, 2009, the U.S. District Court ruled in Feld Entertainment's favor (published as ASPCA v. Feld Entertainment, Inc.,
677 F. Supp. 2d 55 (D.D.C. 2009)). In its ruling the Court stated that,
"the Court finds that Mr. Rider is essentially a paid plaintiff and
fact witness who is not credible, and therefore affords no weight to his
testimony regarding the matters discussed herein, i.e., the allegations
related to his standing to sue."
That
decision found that the plaintiffs' litigation was based on the
untruthful testimony of a paid plaintiff and witness who the Court found
received at least $190,000 in payments as his sole source of income
over an eight year period by animal special interest groups, including
ASPCA, their lawyers and an entity founded and controlled by those
lawyers, the Wildlife Advocacy Project.
The Court also ruled,
"that ensuring Mr. Rider's continued participation as a plaintiff was a
motivating factor behind the payments to him, and that these payments
were a motivating factor for his continued involvement in the case." The
Court also ruled against the other plaintiffs in the case: "because the
organizational plaintiffs have not established an injury in fact,
traceable to FEI's actions that can be redressed by the Court, the
organizational plaintiffs have no standing to sue under Article III of
the United States Constitution."
Furthermore, the Court ruled that
"based upon his failure to complain, the Court finds that Mr. Rider
either (1) did not witness elephant mistreatment when he was employed by
FEI or (2) any mistreatment he did witness did not affect him to the
extent that he suffered an aesthetic or emotional injury." The Court's
December 2009 ruling was affirmed in its entirety by the Court of
Appeals on October 28, 2011.
Based upon what was revealed in ASPCA, et al., v. Feld Entertainment, Feld
Entertainment brought suit in the United States District Court for the
District of Columbia against ASPCA, HSUS and other animal rights
activists and their lawyers alleging violations of the RICO statute and
Virginia Conspiracy Act, malicious prosecution, and abuse of process.
The court denied the defendants' motions to dismiss that case on July 9,
2012.

CIRCUS VARGAS ( USA )
Circus Vargas is an American circus
based in California. It was built on the premise to bring an old time
circus to everyone; currently it has been billed as one of the world’s
biggest traveling circuses still using a big top tent. Owned and
operated by Tabares Entertainment, the circus currently produces a truck
circus show, throughout the western United States.
In the mid-1960s Clifford E Vargas began laying the foundation that
would lead, not only to his recognition, but also to his domination of
the world of circus.
Vargas’ mission to rejuvenate the Big Top
was undoubtedly influenced by his childhood fascination with the
circus. He was a frequent spectator at circuses that every year visited
his hometown of Livermore, California,
where his Portuguese-descended family maintained a farm. Vargas began
as the ticket seller, doorman and ringmaster. During his life with the
circus, he transformed it into a three-ring spectacular, traveling the
world and competing with the best of the best, all the while in old
circus style canvas tents.
After the death of Clifford Vargas in 1989, the show was left to Jack
Bailey, longtime Vice President of the company and Joseph Muscarello,
the show's general manager. Bailey sold his interest to concession
manager Roland Kaiser and the both Kaiser and Muscarello, both longtime
friends of Vargas and management executives with the show, joined forces
and took the reins of the Circus.

Through their tenure, there were many obstacles; rising costs and declining attendance were just a few. Kaiser and Muscarello were instrumental in transforming the circus into a more intimate one-ring ‘European style’ circus. They continued running the circus until they retired in 2003. It was then that the Circus went on hiatus looking for a buyer. Two years later the Tabares Family stepped in and have been running Circus Vargas ever since.When the Tabares family heard of the closing of Circus Vargas, the circus that launched their career, they were truly saddened. They became US citizens and launched Tabares productions to become the new proud owners of Circus Vargas. During their tenure they have brought back the family friendly feeling of the show, as well as steering away from wild animal acts and concentrating on the human spectacles.

CIRCUS HERMAN RENZ
Circus Herman Renz is the largest circus in the Netherlands, and has been touring the Netherlands and other countries since 1911.
Arnold van der Vegt decided in the winter of 1911 to start his own circus. The first artist he contracted was his friend Tom Mix. In 1923 Arnold changed the name of the circus to "Renz". During the Second World war it was difficult for the circus to survive, and because of the circumstances it was forced to give shows for the Germans. After the war, things improved dramatically. Arnold died in 1955.
After the death of Arnold van der Vegt, his son Herman Sr. took over management of the circus. In 1970 he transferred the running of the circus to his sons, Paul and Arnold Jr. (also known as Nol). Paul acted as a clown in the shows and Arnold Jr. became the director.
Arnold Jr. and his wife Marina made the circus very successful. For many years they traveled around with great success. In 1967 their son Herman Jr. was born. As a child, Herman's ambition was to continue his fathers circus business.
The success of circus Renz reached its peak in 1978. In 1978, Bassie and Adriaan made several television series with Circus Renz as the backdrop. In the weekends, they made their appearance in the circus with successful clown performances. During this period the shows were regularly sold out.
In 1980 the Dutch TV-producer Joop van den Ende established Circus Bassie & Adriaan. The staff of Circus Renz was involved with the entire transport of Circus Bassie & Adriaan. Circus Renz itself travelled throughout the country. At the end of 1983 Joop van den Ende stopped with the circus after he tried a show with the Dutch singer André Hazes.
At Circus Renz the Steijvers family reinforced the program, followed by the Luycx-Sisters in 1983. Herman Jr. fell in love with Diana Luycx and they started a relationship.
Arnold Jr. again came in contact with Bassie and Adriaan in 1985. The cooperation between them was renewed and the success of circus Renz grew yet again. But, in 1988, Arnold Jr. became very ill. His last and largest wish was to travel once more with Bassie and Adriaan and a complete new circus-tent. The new tent was bought, but in January 1989 Arnold van der Vegt Jr. died of cancer. Because the new tour was already planned, Bassie and Adriaan decided to finish the tour after which, in 1989, the tent and material was sold.
In 1990 Herman Jr., and his girlfriend Diana, perform for one season with the French circus Achille Zavatta II. Despite this, Herman wanted to continue the Circus Renz with Diana, and the families of Steijvers and Ronday.
In September 1990 Diana & Herman Renz broke the contract with the Circus Achille Zavatta II. On March the 13th 1991 they open with the renewed 'Dutch National Circus Herman Renz'. The first place of the tour is Eemnes. For the young board of directors it is a heavy venture, but thanks to a contract with Center Parcs it developed into a large success.
In five years time, the now-married Diana & Herman Renz develop the circus into the largest in the Netherlands and later the Benelux. During the period around Christmas the circus always present their Wintershow in the Dutch city of Haarlem. In December 1995 Diana & Herman Renz received the Oscar Carré Trophy. The trophy is handed over by the Swiss circus director Frédy Knie of Circus Knie.
There were plans for the year 1996. A new tent had been ordered and there was a new contract with Center Parcs. The tour of 1996 started at February 22 in the Dutch city of Hilversum.
March 13, 1996. On Centerparc 'Het Vennenbos', the circus had arrived in the Dutch city of Hapert. Herman & Diana had not shown themselves that day. Manager Robert Ronday, looking for them at their, finds Herman & Diana dead. It was later determined that Diana & Herman died because of carbon monoxide poisoning.
The shows and the tour were temporarily cancelled. Some days later, the Circus is relocated to the Dutch city of Haarlem, where the funeral is to take place.
After the funeral ceremony, the funeral proceeds to Amsterdam, where Diana & Herman are buried at the family tomb at the cemetery 'Zorgvlied'.
A week after the burial the Herman's mother announces the she wants to sell the circus for 800,000 Dutch guilders. The largest circus of the Benelux stands to the edge of the abyss.
From several places help is unexpectedly offered. The, then, nine years old Ronald Blom starts an action which generates a lot of publicity. Ronald is seen among a lot of television shows such as 'The TV-Show of Ivo Niehe', 'Hart van Nederland' and 'Het Jeugdjournaal' (the news for youth). There is even a story in the local newspaper of Haarlem ('Haarlems Dagblad'). Ronald also collects money (in total 1,012 guilders). For his commitment he receives a free ticket for life of the interim executive board.
Also, Ed Glas organised actions to save the circus, together with the interim executive board of the circus, Toin Routers (public relations officer of the circus in 2005) and Hans de Jager. A fan club was set up, and individuals and companies can rent a chair in the Circus as sponsors.
Princess Household Appliances, a company located in the Dutch city of Breda owned by Aad Ouborg, is sponsors the circus. Because of that, Princess becomes the most important sponsor of circus Herman Renz until 1998. Nowadays, the circus is owned by the families Steijvers, Ronday and Olivier. The executive board consists of five people.
On December 22, 2002 circus Herman Renz received royal recognition. Mayor Jaap Pop (mayor of the Dutch city of Haarlem) had the honour of presenting the award. Circus Herman Renz was the first Dutch circus to receive this award, which motivated the employees of Circus Herman Renz to preserve the last great Dutch circus. During December and January, Circus Herman Renz presented its famous 'Wintershow'. During this period, visitors voted for their favorite artists. The winner received the 'Haarlemse Publieksprijs' (The Harlem Audience Award).

CIRCUS CHARLES KNIE (Germany)
The Circus Charles Knie is founded by Charles and Doriana Knie back in 1995.
In the early years, the circus made a name as a "Magical circus". Charles Knie, who comes from the Swiss Knie Dynasty, 2006 sold his circus to Sascha Melnjak and emigrate to Australia. The entire circus was replaced and bought a new tent with 38.5 meters in diameter from the Italian manufacturer Scola Teloni. This new circus was set up in April 2008. for the first time in Flensburg. In fall 2008, director Sascha Melnjak was awarded by the Circus Friends Association (GCD).
Since 2010 the program has been modernized and turned into a big circus revue. A journey with animals, and international star performers, show-ballet and live orchestra of Circus Charles Knie will load approximately 500,000 visitors annually.
The Circus Charles Knie traveled annually about 50 cities in Germany, with nearly 100 employees, more than 100 animals and more than 200 vehicles, one of the last three grand circus businesses in Germany. In 2012. Sascha Melnjak bought the former winter home of the Circus Barum.
In the early years, the circus made a name as a "Magical circus". Charles Knie, who comes from the Swiss Knie Dynasty, 2006 sold his circus to Sascha Melnjak and emigrate to Australia. The entire circus was replaced and bought a new tent with 38.5 meters in diameter from the Italian manufacturer Scola Teloni. This new circus was set up in April 2008. for the first time in Flensburg. In fall 2008, director Sascha Melnjak was awarded by the Circus Friends Association (GCD).
Since 2010 the program has been modernized and turned into a big circus revue. A journey with animals, and international star performers, show-ballet and live orchestra of Circus Charles Knie will load approximately 500,000 visitors annually.
